BOOKING CONDITIONS

It is essential to take time to carefully read and understand the following Booking Conditions prior to booking a tour with LUSH Pathways. These conditions apply to all tours on LUSH Pathway’s website (www.lushpathways.com) as well as any Custom Trip or Special Departure. By booking and paying the required Confirmation Deposit per person, per tour, you acknowledge that you have read, understood and entirely agreed to LUSH Pathways Booking Conditions, which is a contract between you (the Client) and LUSH Pathways (or the Company). We also recommend that you read and understand the itinerary and the style of tour that you will be signing up for, prior to booking.

The prices on the Company’s website are stated in $ American Dollars (USD). Please contact us prior to booking for prices in £ British Pounds (GBP) or € Euros (EUR). Prices will be converted to Pounds or Euros as per local costs and exchange rate in Brazil. We do not accept other currencies.

By booking a tour with LUSH Pathways, the Client agrees to be bound by these Booking Conditions which outline, amongst other things, the Company’s cancelation policy and certain limitations of liability.

  1. BOOKING REQUIREMENTS & CONFIRMATION DEPOSIT
    The booking is made through our Booking Request form on our website. Once the booking request has been received, the Client will receive an email confirming acceptance/availability of the tour chosen, outlining services requested and outstanding payments due.
    The Client is then required to pay a non-refundable “Confirmation Deposit” of USD $300 or EUR €250 or GBP £200 per person, per tour within 3 days. The remaining balance is due 60 days prior to the tour departure date. If the booking is made within 60 days of the departure date, the Full Payment (excluding Final Payment for Group Tours and Special Departures) is due within 3 days of the Client receiving the confirmation email. If the tour chosen costs USD $600 or less, then the Client is required to pay the full amount (instead of the Confirmation Deposit) within 3 days of the Client receiving the confirmation email. Note that a higher amount for the Confirmation Deposit may apply for Custom Trips and Special Departures.
    Payment is considered to have been made only once there is bank confirmation of the payment having arrived in the Company’s bank account. After payment has been received, the Client will receive a booking confirmation outlining services booked and the remaining balance due (if any). A receipt will be sent to the Client only after Full Payment has been received. The tour will only be fully confirmed once the Client has sent all required booking details to LUSH Pathways as per clause 2.
    Note that if the remaining balance has not been received as specified above and unless prior arrangements have been made with the Company, the Company reserves the right to treat the Client’s booking as cancelled and the Client’s place will become available to another potential customer. Note that cancellation conditions apply as per clause 8.
    In addition to the above conditions, the following conditions apply to all Carnival tours:
    The Client is required to pay a non-refundable “Confirmation Deposit” of USD $500 or EUR €400 or GBP £350 per person, per tour/package within 3 days. The remaining balance is due 90 days prior to the tour/package departure date. If the booking is made within 90 days of the departure date, the Full Payment is due within 2 days of the Client receiving the confirmation email. Back to Top


  2. CLIENT DETAILS
    In order for LUSH Pathways to fully confirm the Client’s travel arrangements and issue a voucher, the Client must provide all required booking details after the remaining balance has been paid and no less than 30 days prior to the tour departure date. Required details include full name, nationality as per passport, date of birth, passport number and expiry date, complete address, contact email and telephone, flight details, complete travel insurance details, person and telephone number to contact in case of emergencies. The Client’s booking can not be fully confirmed and the Company can not issue a voucher without provision of these details. Back to Top


  3. AGE & FITNESS REQUIREMENTS
    For Independent Tours and Volunteer Programs the Client must be at least 18 years of age.
    For Group Tours and Special Departures, any Client 18 years or older can join a LUSH Pathways tour. In special circumstances where a Client is under the age of 18, the person may be allowed on a tour if accompanied by an adult family member over the age of 21.
    Custom Trips are open to families with children over the age of 5 years. For children under the age of 12 years, special cases may be considered depending on the circumstances and location chosen as Brazilian laws are quite strict for children travelling without the presence of both parents.
    The Client needs a minimum level of fitness and mobility. As a minimum requirement, the Client must be able to walk without the aid of another person, climb 3-4 flights of stairs, step on and off of buses and carry one’s own luggage.
    For elderly Clients we stress that adventure travel is inherently more rigorous than conventional vacations and can be physically demanding.
    While the Company’s Tour Leaders (for Group Tours and Special Departures) work hard to ensure that all LUSH Pathways travellers are catered for equally, it is not their responsibility to help individuals who cannot complete the day’s activities unaided. Back to Top


  4. GUARANTEED DEPARTURES & GROUP SIZE – only applies to Group Tours and a few Special Departures.
    LUSH Pathways Independent Tours, Volunteer Programs and Custom Trips are guaranteed to depart with a minimum of 1 fully paid traveller. For Group Tours and Special Departures, LUSH Pathways guarantees departure once there are 4 fully paid travellers, up to a maximum of 10 travellers. If there are less than 3 travellers booked on the tour, the Client will receive a booking confirmation by email holding the Client’s place on the tour. This is a natural procedure for all Group Tours and Special Departures. As soon as the tour is guaranteed to depart (with a minimum of 4 travellers booked), the Client will receive an email reconfirming the booking and stating that the tour is now guaranteed to depart and that he/she can confidently book flights and make all travel arrangements for the trip. For all tours/programs, “Force Majeure” applies as per clause 11 in this contract.
    The Company may consider adding more than 10 travellers to a tour depending on the location chosen, up to a maximum of 15 travellers. Back to Top


  5. FINAL PAYMENT
    The Final Payment is a common practice in the tourism industry for these kinds of tours. The Final Payment is a convenient and easy way for the Company to get cash to the Tour Leader to pay for some of the expenses during the tour. It is a nominal proportion of the funds that are required to run the tour. The Final Payment is in addition to, and not included in, the base tour price.
    The Final Payment must be paid locally to the Tour Leader on the first day of the tour. This will be accepted exclusively in cash: USD American Dollars or preferably the Brazilian currency, the Real, which can be withdrawn from an ATM machine in Brazil. The Client will be informed of the amount to be paid in Brazilian Reais in the welcome letter, which will be found in the start hotel on the first day of the tour. The welcome note will also contain other information relevant to the tour. The rate used will be the exchange rate according to www.xe.com on the starting date of the tour. If the Client fails to pay the Final Payment to the Tour Leader, the Client will forfeit all included activities and potential complimentary services offered by the Company. These will have to be paid for out of the Client's own pocket at local rates and with no special prices or discounts. Back to Top


  6. TRAVEL INSURANCE
    Travel insurance is mandatory for all Clients travelling with LUSH Pathways and should be organized by the Client. The Client's travel insurance must cover personal accident, death, medical, repatriation and evacuation expenses. The Company's minimum insurance policy for medical emergency, evacuation and repatriation is USD $200,000 (or the equivalent in other currencies). LUSH Pathways strongly recommends that the coverage be extended to include cancellation, curtailment, personal liability, loss of luggage and personal belongings and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client. The Company cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by the Company such as hotels, vehicles or any other mode of transportation. The Client must provide proof of travel insurance to the Company after the full payment is made, no less than 30 days prior to the tour departure date. The Client will also be required to show proof of travel insurance to the Tour Leader on the first day of the tour for Group Tours and Special Departures. Note that the Client will not be able to travel without Travel Insurance. Back to Top


  7. TRAVEL DOCUMENTATION
    The Client must carry a valid passport (valid for at least 6 months beyond the duration of the tour) and have obtained a Brazilian visa (if required), International Yellow Fever Certificate, and travel insurance policies for the duration of the tour. It is the Client's full responsibility to obtain all the correct documentation for the tour. The Company accepts no responsibility for the Client being refused entry into Brazil because of incorrect documentation. If the Client is refused entry into Brazil because of incorrect documentation, no refunds from the Company to the Client will be due as this will be considered to be a no show. Back to Top


  8. CANCELLATION BY THE CLIENT
    The Client is strongly advised to purchase cancellation insurance which will cover cancellation penalties in certain circumstances. Any cancellations will only be effective when received in writing, by email and will be effective upon its receipt and acknowledgment. The following fees will apply for cancellations:
    • 60 days or more prior to departure, the Company will retain the Confirmation Deposit/s;
    • 59 to 30 days prior to departure, the Company will retain the Confirmation Deposit or 40% of the total tour price (including Final Payment, if applicable) - whichever is greater;
    • Less than 30 days prior to departure, including a no show, the Company will retain 100% of the total tour price;
    • No refunds will be made should the Client voluntarily or involuntarily leave a tour early as per clause 9.
    Custom Trips may vary in cancellation policy from that detailed in this clause and will be detailed at time of booking. Back to Top


  9. UNUSED SERVICES
    There will be no discounts or monies refunded for missed or unused services. This includes voluntary or involuntary termination/departure from tour, i.e. sickness, death of a family member etc, late arrival on the tour, or premature departure either voluntarily or involuntarily. Back to Top


  10. CANCELLATION BY THE COMPANY / LUSH Pathways
    LUSH Pathways reserves the right to cancel Group Tours and Special Departures if there are not the minimum of 4 fully paid travellers required to run the tour. In the case of a Group Tour or Special Departure not confirming 30 days prior to the departure date, the Client will still be able to enjoy their trip to Brazil by doing the same route independently. LUSH Pathways will then place the client on a very similar Independent Tour. The Client will also have the option to choose any other available tour, tailor making a tour or receiving a refund (in this case, the company will retain $70 or EUR €55 or GBP £45 cancelation fee to cover administrative costs). **Because the Company's tours have different prices, the Client might be due a refund or have to pay the difference in price depending on the new tour chosen.

    LUSH Pathways will not cancel a tour less than 30 days prior to departure except for "Force Majeure" as per clause 11 or unusual and unforeseen circumstances beyond the Company's control.
    LUSH Pathways reserves the right to cancel any tours at any time prior to departure or during the tour itself if, due to unusual and unforeseen circumstances beyond the Company's control such as natural disasters, floods, landslides, strikes, political instability, acts of violence or other external events, it is not viable for the Company to operate the tour as per clause 11. In such cases, if necessary, the Company will endeavor to refund the Client once administrative costs to cover cancelled hotels, transportation, excursions and any other cancellation fees due to suppliers have been paid.
    LUSH Pathways will inform the Client as soon as possible of a cancellation of any nature. The Company is not responsible for any incidental expenses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or loss of enjoyment, etc. In the case of a tour that has already departed being cancelled because of Force Majeure, the Company is not responsible for any incidental expenses that the Client may incur as a result of extra accommodation, transport and other additional expenses that may be needed.

    Please note that refunds will not be given for the following:
    • Lost travel time or substitution of facilities.
    • Presence of circumstances beyond Company's control which requires alternative arrangements be made to ensure the safety and enjoyment of the tour.
    • Unused services for any accommodation, activity or tour segment without prior notice.
    • Premature contract termination. Back to Top


  11. FORCE MAJEURE - FACTORS OUTSIDE THE COMPANY'S CONTROL
    "Force Majeure" means, in relation to LUSH Pathways, any unusual and unforeseen circumstances beyond the Company's control (including but not limited to: acts of God; natural disasters, floods, tempests, landslides, explosions, fires, accidents, war or threat of war, terrorism, insurrection, civil disturbance, political instability or strikes, requisition, sickness, quarantine, government intervention, weather conditions or other external occurrences). If LUSH Pathways is affected by force majeure it shall notify the Client of the nature and extent thereof.
    The Company shall not be deemed to be in breach of these items and conditions or otherwise be liable to the Client, by reason of delay in performance or by non-performance of any of its obligations hereunder to the extent that any such delay or non-performance is due to any force majeure.
    If the Company is affected by force majeure it shall be entitled to, and may at its sole and absolute discretion, vary or cancel any reservations or cancel any reservation or arrangement in relation to a tour. In such cases, if necessary, the Company will endeavor to refund the Client where possible, once administrative costs to cover cancelled hotels, transportation, excursions and any other cancellation fees due to suppliers have been paid.
    The Company shall not be liable in any way to the Client for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for the Company's failure to commence, perform and/ or complete any duty owed to the Client if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Force Majeure or any other cause whatsoever beyond the reasonable control of the Company.   12. BOOKING AMENDMENTS
    If the Client wishes to transfer from one tour to another, change a departure date or transfer a booking to a third party, the Client must notify LUSH Pathways at least 30 days prior to the proposed departure date. If the new tour chosen is of a lower value than that originally booked, then the Client is entitled to a refund of the price difference. If the alternative tour chosen is of a higher value than that originally booked, then the Client will have to pay the difference in price. Transfers to another departure can only be made to guaranteed departures in the current season and available on the LUSH Pathways website. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the tour.
    A fee of USD $50 or EUR €35 or GBP £30 per person per change will apply for any changes to cover additional administration and communication costs. The fees charged will be in addition to any charges levied by hotels, ground operators or airlines (if any). Amendments after the tour has started shall be considered depending on local circumstances and availability - a fee of USD$70 or EUR €50 or GBP £45 per person per change will apply. Back to Top


  13. PRICES & SURCHARGES
    LUSH Pathways tour prices are based on currency exchange rates as of January 2012. The Company reserves the right to adjust the prices published on the Company's website without prior notice and impose surcharges (price increases) up to 45 days before departure due to unfavorable changes in exchange rates, increases in local operator costs, transportation, taxes, or if government action should require the Company to do so. If any surcharge results in an increase of more than 10% of the tour price the Client may choose between applying the amount paid toward an alternative tour or cancelling the booking within 10 days of notification of the surcharge and receiving a full refund.   14. FLEXIBILITY & CHANGES
    The Client appreciates and acknowledges that the nature of this type of travel requires considerable flexibility and should allow for changes by LUSH Pathways. The itinerary presented for each tour is representative of the types of activities contemplated and the Company is under no contractual obligation to strictly follow it. It is understood that the route, schedules, itineraries, amenities and modes of transport may be subject to change without prior notice due to local circumstances or events, which may include sickness, mechanical breakdown, flight cancellations, strikes, events emanating from political disputes, climate and other unpredictable or unforeseeable circumstances.
    LUSH Pathways reserves the right to change an itinerary or any of the facilities or activities after departure due to unpredictable or unforeseeable local circumstances or events outside of the Company's control as per clause 11. In such circumstances, the additional cost of any necessary alterations will be covered by the Client. The Company recommends that the Client have approximately USD $500 or EUR €350 or GBP £300 for Emergency Funds, to be used in such instances. Please note that the Company is not responsible for any incidental expenses that may be incurred as a result of changes to the itinerary caused by the reasons outlined above.
    While LUSH Pathways endeavors to operate all tours as per the itinerary presented in the tour description, the Company reserves the right to make reasonable changes to the itinerary where deemed necessary or advisable by the Company.   15. ACCEPTANCE OF RISK
    The Client acknowledges that the nature of this type of travel is adventurous and participation involves a certain degree of personal risk. The Client hereby assumes all such risk and does hereby release LUSH Pathways and its officers, employees, agents and representatives from any liability and from all claims and causes of action arising out of or in connection with the Client's participation in a tour and from any damages, injuries or death resulting from these inherent risks. The Client accepts that any suggestion for any activities or any assistance given by LUSH Pathways, the Tour Leader or the Local Representative to arrange such activities does not render the Company liable for said activities. The Client understands that the Client assumes full responsibility for any risks involved in included activities and optional activities. LUSH Pathways and its owners, directors, management staff and employees, including sub-contracted or local operators and their employees, shall not be held responsible for any injury, damages or death to persons on tour or during the activities, nor for loss of or damage to personal property, however they may be caused. It is the Client's sole responsibility to obtain appropriate medical advice as to medication, immunization, and whether or not the Client is fit enough to undertake the trip, prior to departure. The Company shall not be liable for illness, injury or death sustained whilst visiting properties owned and/or managed by the Company and/or the Company's partners. Back to Top


  16. RESPONSIBILITY FOR YOUR TOUR
    All services herein are organized by LUSH Pathways. Notice is hereby given that all arrangements made on behalf of the Client are made by the Company on the sole condition that the Company shall not be held responsible for any injury, death, accident, delay, loss, damage, or any irregularity which the Client may suffer (directly or indirectly) in connection with or arising out of the Client's participation in a tour which may be occasioned through acts of the Company, any sub-contracted or local operators and/or persons engaged in carrying out the arrangements. LUSH Pathways acts as an agent for transport companies, hotels and other contractors and is not responsible for the acts and omissions of these third parties and shall not be held liable for any injury, damage, loss, delay or irregularity that may occur, including, but not limited to, any defect in a vehicle or any other form of conveying a traveller, acts of God, detention, delays or expenses arising from quarantine, strike, riots, theft, force majeure, civil disturbance, government restriction or regulation, accident by aircraft, boat, bicycle, motor vehicle or any other form of transport or in any hotel or guesthouse, or other form of accommodation. The Client acknowledges that the quality of the products organized by the Company, including accommodations and all other services related to the tour which are organized by the Company, are not within the control of the Company and that in any event the quality of such products may be compromised by local conditions. Accordingly, the Client hereby releases LUSH Pathways from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to the quality of such products. The information contained in this website is correct to the best of the Company's knowledge and the Company accepts no liability for any innocent inaccuracies contained herein. LUSH Pathways reserves the right to alter any itinerary in progress or service at any time without penalty to the Company. Any additional expense or cancellation shall be borne by the customer. The Company reserves the right to withdraw or refuse any service to any customer at the discretion of the Company. Back to Top


  17. LOCAL CONDITIONS
    The Client acknowledges that he/she will be visiting places where the political, cultural and geographical attributes present certain risks, dangers and physical challenges different and greater than those present in his or her daily life. By booking travel with LUSH Pathways, the Client acknowledges that it is his or her own decision to travel and that he or she has considered the potential risks, dangers and challenges involved and expressly assumes the risks attendant to such travel conditions. The Client is solely responsible for acquainting himself or herself with the customs, weather conditions, physical challenges and laws in effect at each stop along the itinerary and is encouraged to locate or make contact prior to embarkation with his or her local embassy or consulate in each destination. LUSH Pathways shall not be liable for any political, cultural and geographical situations that may occur. Back to Top


  18. SUPPLIERS CONDITIONS
    Airlines, railways, coach and shipping companies and other suppliers have their own booking conditions or conditions of carriage, and the Client will be bound by these as far as the relevant transport provider or supplier is concerned. The Company is not responsible for the acts or omissions of these third parties. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other supplier, and they are often also subject to various international conventions. The Company's liability will be limited to and shall not exceed that of its suppliers. The Client is precluded from making a double recovery by making the same claims and seeking the same recovery against LUSH Pathways and its suppliers. Back to Top


  19. BAGGAGE
    The Company assumes no liability for loss or damage to baggage in transit to and from a LUSH Pathways trip or while on a LUSH Pathways trip. Back to Top


  20. AUTHORITY ON GROUP TOURS AND SPECIAL DEPARTURES
    LUSH Pathways Group Tours and the majority of LUSH Pathways Special Departures are run by a LUSH Pathways Tour Leader. The decision of the Tour Leader is final on all matters likely to affect the safety or well-being of any person participating in the tour. By booking with the Company, the Client agrees to abide by the authority of the Tour Leader, who represents the Company. The Client is expected to keep in mind that he or she is travelling in a group and must at all times comply with the laws, customs, and foreign exchange and drug regulations of Brazil. If the Client fails to comply with a decision made by the Tour Leader, commits any illegal act, interferes with the well-being, safety or enjoyment of the group, or if the behaviour of the Client is, in the opinion of the Tour Leader, causing danger, distress or annoyance to others in the group or outside of the group during the tour, or negatively affecting the enjoyment of the tour by other people, the Tour Leader may order that he or she to leave the tour immediately, with no right of refund. The Company will terminate that Client's remaining travel arrangements without any liability on the Company's part and the Client will not be entitled to any refund for unused or missed services or costs incurred resulting from the termination of the travel arrangements. LUSH Pathways is not responsible for nor will accept any liability for any Client who commits an illegal or unlawful act while travelling with the Company. Back to Top


  21. CLAIMS & COMPLAINTS
    If the Client has any cause for complaint while travelling, the Client must immediately bring it to the attention of the Tour Leader (if doing a Group Tour or a Special Departure) or LUSH Pathways management who will attempt to resolve the situation at the time. If no resolution is found, the Client must write a letter via email to the Company outlining the complaint no more than 20 days after the tour has ended. The Company will not accept any liability for claims received after this period.

  22. PRIVACY POLICY
    Any personal information that the Company collects about the Client may be used for any purpose associated with the operation of a tour. The information may be disclosed to service providers or other suppliers to enable the Company to operate the tour. LUSH Pathways will otherwise treat the Client's details in accordance with the Company's Privacy Policy. Occasionally, the Company might send the Client marketing material in relation to LUSH Pathways' events and special offers.

  23. CONSENT
    The payment of the Confirmation Deposit or any other partial payment for a reservation constitutes consent to all provisions of these Booking Conditions. The terms under which you, the Client, agree to make the reservation cannot be changed or amended unless this is done in writing and signed by an authorized staff member of LUSH Pathways. All decisions and matters subject to the Company's discretion shall be by an authorized officer of LUSH Pathways. Back to Top
